(DECRETO No. 17-73)

PECULADO CULPOSO

ARTICULO 446. El funcionario o empleado público que, por negligencia o falta de celo,diere ocasión a que se realizare, por otra persona, la sustracción de dinero o efectos públicos de que trata el artículo precedente, será sancionado con multa de cien a un mil quetzales.

MALVERSACIÓN

ARTICULO 447. El funcionario o empleado público que diere a los caudales o efectos que administrare una aplicación diferente de aquella a que estuvieren destinados, será sancionado con multa de cien a un mil quetzales.

La sanción señalada se aumentará al doble, si a consecuencia de la malversación resultare daño o entorpecimiento del servicio a que los caudales o efectos estuvieren consignados.

INCUMPLIMIENTO DE PAGO

ARTICULO 448. El funcionario o empleado público que, teniendo fondos expeditos, demorare injustificadamente un pago ordinario u ordenado por autoridad competente, será sancionado con multa de cien a un mil quetzales.

Igual sanción se impondrá al funcionario o empleado público que, legalmente requerido rehusare hacer entrega de dinero o efectos depositados o puestos bajo su custodia o administración.

CAPITULO V DE LAS NEGOCIACIONES ILICITAS

CONCUSIÓN

ARTICULO 449. Comete el delito de concusión:

1o. El funcionario o empleado público que, directa o indirectamente o por actos simulados, se interesare en cualquier contrato u operación en que intervenga por razón de su cargo. Esta disposición es aplicable a los árbitros, peritos, contadores, tutores, albaceas y síndicos, con respecto a las funciones que como tales desempeñen.

2o. El funcionario o empleado público que, con propósito de lucro, interponga su influencia para obtener una resolución de cualquier autoridad, o dictamen que debe pronunciarse ante la misma.

Los responsables serán sancionados con prisión de uno a tres años y multa de trescientos a tres mil quetzales.

FRAUDE

ARTICULO 450. El funcionario o empleado público que, interviniendo por razón de su cargo en alguna comisión de suministros, contratos, ajustes o liquidaciones de efectos de haberes públicos, se concertare con los interesados o especuladores, o usare de cualquier otro artificio para defraudar al Estado, será sancionado con prisión de uno a cuatro años.

EXACCIONES ILEGALES

ARTICULO 451. El funcionario o empleado público que exigiere contribución, impuesto, tasa o arbitrio ilegales o mayores de los que correspondan, será sancionado con prisión de seis meses a dos años y multa de cincuenta a trescientos quetzales.

Si el funcionario o empleado público convirtiere en provecho propio o de tercero el producto de las exacciones expresadas en el párrafo que precede, las sanciones señaladas se aumentarán al doble.

COBRO INDEBIDO

ARTICULO 452. El funcionario o empleado público que autorice recibos o comprobantes ficticios o quien los cobrare, será sancionado con prisión de uno a tres años y multa de trescientos a tres mil quetzales.

Risk

Sovereign risk

Although fiscal slippage this year is not ruled out, The Economist Intelligence Unit considers the risks associated with Guatemala’s electoral cycle (polls are due in September) to be modest. Were the fiscal deficit to widen beyond the 2.3% of GDP currently forecast in 2015, this would not by itself affect the country’s BB rating and we would expect the incoming government to make adjustments.

Banking sector risk

Credit growth has picked up recently to 12% in March 2105, but remains moderate, reflecting a fairly conservative approach to lending by Guatemala’s private banks. We expect the banking system to withstand the rise in US and local interest rates in the medium term relatively smoothly.

Political risk

Guatemala’s commitment to pay is firm. However, the government’s capacity is constrained by governance problems, with the current administration increasingly unable to advance any reforms in the legislature. September’s general election is unlikely to lead to a swing in economic policies.

Economic structure risk

Low income levels, high levels of inequality, vulnerability to fluctuations in commodity prices, a large external financing requirement and weaknesses in the public finances weigh on Guatemala’s rating. Risk is mitigated by good relations with multilateral lenders and improved business confidence.
